Libya: Why This Revolt Was Ripe To Happen Now

From Denny: An update on the evolving situation in Libya. There are still about 300 Americans trapped in the chaos and another 100,000 internationals trying to evacuate. Gadhafi is threatening to blow up the country if defeated. No one is sure if that means by atomic bombs or conventional - or if he will actually do it.

Gadhafi has lost most support in the international community and among his diplomats, politicians and military. All that remains are the usual suspects: the loyalist Republican Guard. Sooner or later they too will see overwhelming odds of armed protesters and throw in with them much like the police did in Egypt. It is a matter of time before the armed protesters take Tripoli as they have many other cities across the country.

EXECUTIVE ORDER
BLOCKING PROPERTY AND PROHIBITING
CERTAIN TRANSACTIONS RELATED TO LIBYA
     By the authority vested in me as President by the Constitution and the laws of the United States of America, including the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.) (IEEPA), the National Emergencies Act (50 U.S.C. 1601 et seq.) (NEA), and section 301 of title 3, United States Code,
     I, BARACK OBAMA, President of the United States of America, find that Colonel Muammar Qadhafi, his government, and close associates have taken extreme measures against the people of Libya, including by using weapons of war, mercenaries, and wanton violence against unarmed civilians.  I further find that there is a serious risk that Libyan state assets will be misappropriated by Qadhafi, members of his government, members of his family, or his close associates if those assets are not protected.  The foregoing circumstances, the prolonged attacks, and the increased numbers of Libyans seeking refuge in other countries from the attacks, have caused a deterioration in the security of Libya and pose a serious risk to its stability, thereby constituting an unusual and extraordinary threat to the national security and foreign policy of the United States, and I hereby declare a national emergency to deal with that threat.
     I hereby order:
     Section 1.  All property and interests in property that are in the United States, that hereafter come within the United States, or that are or hereafter come within the possession or control of any United States person, including any overseas branch, of the following persons are blocked and may not be transferred, paid, exported, withdrawn, or otherwise dealt in:
     (a)  the persons listed in the Annex to this order; and
     (b)  any person determined by the Secretary of the Treasury, in consultation with the Secretary of State:
 (i)    to be a senior official of the Government of Libya;
  (ii)   to be a child of Colonel Muammar Qadhafi;
(iii)  to be responsible for or complicit in, or responsible for ordering, controlling, or otherwise directing, or to have participated in, the commission of human rights abuses related to political repression in Libya;
(iv)   to have materially assisted, sponsored, or provided financial, material, logistical, or technical support for, or goods or services in support of the activities described in subsection (b)(iii) of this section or any person whose property and interests in property are blocked pursuant to this order;
(v)    to be owned or controlled by, or to have acted or purported to act for or on behalf of, any person whose property and interests in property are blocked pursuant to this order; or
(vi)   to be a spouse or dependent child of any person whose property and interests in property are blocked pursuant to this order.
     Sec2.  All property and interests in property that are in the United States, that hereafter come within the United States, or that are or hereafter come within the possession or control of any United States person, including any overseas branch, of the Government of Libya, its agencies, instrumentalities, and controlled entities, and the Central Bank of Libya, are blocked and may not be transferred, paid, exported, withdrawn, or otherwise dealt in.
     Sec3.  For those persons whose property and interests in property are blocked pursuant to this order who might have a constitutional presence in the United States, I find that because of the ability to transfer funds or other assets instantaneously, prior notice to such persons of measures to be taken pursuant to this order would render those measures ineffectual.  I therefore determine that for these measures to be effective in addressing the national emergency declared in this order, there need be no prior notice of a listing or determination made pursuant to section 1 of this order.
     Sec4.  I hereby determine that, to the extent section 203(b)(2) of IEEPA (50 U.S.C. 1702(b)(2)) may apply, the making of donations of the type of articles specified in such section by, to, or for the benefit of any person whose property and interests in property are blocked pursuant to sections 1 and 2 of this order would seriously impair my ability to deal with the national emergency declared in this order, and I hereby prohibit such donations as provided by sections 1 and 2 of this order.
     Sec5.  The prohibitions in sections 1 and 2 of this order include but are not limited to:
     (a)  the making of any contribution or provision of funds, goods, or services by, to, or for the benefit of any person whose property and interests in property are blocked pursuant to this order; and
     (b)  the receipt of any contribution or provision of funds, goods, or services from any such person.
     Sec6.  The prohibitions in sections 1 and 2 of this order apply except to the extent provided by statutes, or in regulations, orders, directives, or licenses that may be issued pursuant to this order, and notwithstanding any contract entered into or any license or permit granted prior to the effective date of this order.
     Sec7.  (a)  Any transaction by a United States person or within the United States that evades or avoids, has the purpose of evading or avoiding, causes a violation of, or attempts to violate any of the prohibitions set forth in this order is prohibited.
     (b)  Any conspiracy formed to violate any of the prohibitions set forth in this order is prohibited.
     Sec8.  Nothing in this order shall prohibit transactions for the conduct of the official business of the Federal Government by employees, grantees, or contractors thereof.
     Sec9.  For the purposes of this order:
     (a)  the term "person" means an individual or entity;
     (b)  the term "entity" means a partnership, association, trust, joint venture, corporation, group, subgroup, or other organization; and
     (c)  the term "United States person" means any United States citizen or national, permanent resident alien, entity organized under the laws of the United States or any jurisdiction within the United States (including foreign branches), or any person in the United States.
     Sec10.  The Secretary of the Treasury, in consultation with the Secretary of State, is hereby authorized to take such actions, including the promulgation of rules and regulations, and to employ all powers granted to the President by IEEPA as may be necessary to carry out the purposes of this order.  The Secretary of the Treasury may redelegate any of these functions to other officers and agencies of the United States Government consistent with applicable law.  All agencies of the United States Government are hereby directed to take all appropriate measures within their authority to carry out the provisions of this order.
     Sec11.  The Secretary of the Treasury, in consultation with the Secretary of State, is hereby authorized to determine that circumstances no longer warrant the blocking of the property and interests in property of a person listed in the Annex to this order, and to take necessary action to give effect to that determination.
     Sec12.  The Secretary of the Treasury, in consultation with the Secretary of State, is hereby authorized to submit the recurring and final reports to the Congress on the national emergency declared in this order, consistent with section 401(c) of the NEA (50 U.S.C. 1641(c)) and section 204(c) of IEEPA (50 U.S.C. 1703(c)).
     Sec13.  This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.
     Sec14.  This order is effective at 8:00 p.m. eastern standard time on February 25, 2011.

From Denny: Finally, President Obama announces sanctions on Libya again. This Libyan dictator spent decades in sanctions limbo only to get thrown back into sanctions prison yet again. This guy should have been overthrown a long time ago.

Obama says he is freezing Libyan nationals' financial assets and there are economic sanctions to be put in place as well. He has not said what the specifics are to be exactly, as yet undetermined pending review of what will work best. Read that as he and his staff don't know and will be running around asking all the so-called experts what to do.

So far Obama has phoned key allies like UK Prime Minister Cameron, Prime Minister of Turkey, skirt-chasing Italy's Berlusconi and the United Nations Secretary General. Obama does not want to institute a no-fly zone but does not say why. The American embassy in Libya has been shuttered and closed down. Well, yeah, the country is in the process of becoming a failed state quickly.

One thing Obama did get right was to "hold his powder" as my Grand Dad used to say. Obama refused to satisfy the critics who demanded he come out and start screaming at and denouncing Gadhafi when the protests began. Well, there was the little matter of many hundreds of embassy and oil industry personnel still present in this chaotic country and we had to get them out safely. Today, a plane took off from the capitol city of Tripoli with Americans glad to leave that nightmare. Others arrived after 60 hours trapped on a ferry. But at least they are out now.

Egypt: Protesters New Agenda: Overthrow Interim Government

From Denny: What's been going on in Egypt since the protesters won? They cleaned up Tahrir Square and went back to work and school. With the Army leading the interim caretaker government, emotions still run high and so does the uncertainty of the country's future.

The world thought everything was settled and the country had decided upon a temporary course. Why the march? The democracy activists believe the interim government retained far too many old familiar faces from the Mubarak regime.  They just don't trust them to deliver a true democracy to the people.

Tuesday of Challenge March 

Online organizers are calling the rally "Tuesday of Challenge." They hope to gather a million strong. The protesters desire to put pressure, and keep up the pressure, on the current Army-regent administration, leading until an election can be held. They plan yet another march on Friday too.

They say their slogan this week of marches is "The people want the overthrow of the regime." You can't get any more clear than that.

From their Facebook page: "We are going back to Tahrir (Liberation) Square and we will stay there. The higher (military) council has left Mubarak's government to do what it wants."

Opposition Leader Mohamed El Baradei 

From Mohamed El Baradei, a leading opposition figure and well respected in the country and around the world, supports continued protests. He, too, is frustrated with what appears to be "cosmetic change" in the current government which he condemns as an "insult to the revolution."

From El Baradei's Twitter page: "Continued mass, peaceful protests - and the formation of a party, including those who launched the revolution - are our way to complete the journey of change. The regime will not be reformed from within the regime."

How the protesters view the current cabinet

Remember how the Prime Minister, Ahmed Shafig, said they were choosing new ministers? Well, over a week later, they are still in process and people are becoming suspicious of what may be truly transpiring behind the scenes.  This cabinet currently still in power was appointed by Mubarak and nothing has changed since Mubarak stepped down. The protesting Facebook group say they prefer a government of technocrats.

From activist Ahmed Naguib: "A conference tomorrow will announce a call for a Friday march in the millions across Egypt - and in Tahrir Square - in response to the latest changes in interim government - and to reassert the demands of the people's revolution." Naguib did admit some changes made in government posts were "some good moves toward reform and change - but still not enough."

Where does the Egyptian military stand on their progress?

The military rulers promised many changes to the constitution. They announced that the constitutional changes necessary to hold elections should be ready soon. They are fully aware that any signs the Army might renege on their promise of true civilian and democratic rule could reignite massive protests again.

From Denny: The Egyptian people are still walking ten feet off the ground today as they begin the process of getting back to work. There are those still protesting in the Tahrir Square, afraid the military may not make good on their promises to meet the Revolution demands.

Already the military is moving to establish order, calm the world about peace agreements and begin the process to create political parties and elections. They have dismissed Parliament and are reshuffling government management.  Read that as they are sifting out the nepotism posts.

America continues to enjoy a good relationship with the Egyptian military so chances are Obama - or at least the Pentagon - will be kept in the loop on information as it develops in Egypt. Hopefully, all the established democracies in the world are offering help, assistance, ideas on how to get Egypt on track quickly to their own version of a democracy.

Meanwhile, there is the thorny issue of whether to prosecute Mubarak and others in his administration for theft of national funds or crimes committed under the thoroughly hated and feared Emergency Law. After all, there are still present the 350,000 Secret Police that have savaged the 80 million people for 30 years.

Mubarak has been informed not to leave the country. His funds have been frozen by Swiss banks but Mubarak is cagey and squirreled away monies all over the world - some probably right here in America. Obama says he is doing a thorough investigation into whether Mubarak has funds here, probably since I brought it up in a post the other day.

Yeah, they read me at the White House, at the Pentagon and in the world intelligence community for the same reason my father's precious CIA guys used to listen to me: to see how much their BS is believed or not. Obviously, not for the right reason of doing the right and honorable thing toward the people of America or the world. Oh, well, guess when the time comes for them to meet St. Peter at The Pearly Gates they can't tell God that no one counseled them with The Truth.

It is amazing how leaders in the government, the military and the intelligence communities really make life hard on themselves and everyone around them. If they just swept aside their bloated egos, quit with the cover-ups to protect their pride, life could be so simple and a lot healthier and more prosperous for everyone.

From Denny: The Egyptian people continue their hard struggle toward a free and open democracy. The protesters have this much time and effort invested in pushing out a corrupt leader they might as well go the distance and finish the job.

Have you ever noticed when a world event like this takes place that the surrounding observer nations all view the event from their own prism of concerns, wants and needs? Everyone is looking at this Egypt Revolt as "What's in it for me?" instead of the more compassionate and wise approach of "What is best for the Egyptian people?"

World leaders and Big Business place their concerns as to how much oil is going to cost us. Journalists worry about whether their freedom of speech is hampered. Political analysts speak with one voice, wailing and crying loudly, "Oh, Egypt is going to the dogs! Terrorists, the Muslim Brotherhood, will gain control of the government and the world!"

The Think Tank people worry about Egyptian foreign policy and how to angle it to America's advantage. Religious extremists try to gain control so they can be the ones running the dictatorship and stashing billions of American dollars away in Swiss bank accounts just like Mubarek did.

Other Islamic leaders in the Middle East are sweating bullets of fear, terrified they will be put out of power too, just like the Tunisian leader got chased off.  Meanwhile, Mubarek stalls for time as he moves his stolen money into accounts around the world other governments and the protesters cannot discover.

Over almost 30 years, American taxpayers have given their hard-earned money to Mubarek to the tune of at least $60 billion. It's an obscenity.  There are plenty of school children right here in America, millions of them, who could use updated textbooks and a college education.  Instead, American presidents, to the tune of five of them now, have wasted our money by allowing dictators to pocket it.  The least our presidents could have done is see to it those billions of dollars went to alleviating poverty in Egypt.

Americans would have felt at least the money went to the good of the people instead of getting wasted on excessive indulgences of the Mubarek family who are all billionaires.  I want my money returned to America  Put me on the board of foreign aid and I'll see to it that it is spend appropriately and wisely.  Isn't it time we American voters quit allowing uncaring people to run our government, whichever political party?

ESTABLISHMENT OF THE INTELLECTUAL PROPERTY
ENFORCEMENT ADVISORY COMMITTEES

     By the authority vested in me as President by the Constitution and the laws of the United States of America, including title III of the Prioritizing Resources and Organization for Intellectual Property Act of 2008 (Public Law 110-403)(15 U.S.C. 8111-8116) (the "PRO IP Act"), and in order to strengthen the efforts of the Federal Government to encourage innovation through the effective and efficient enforcement of laws protecting copyrights, patents, trademarks, trade secrets, and other forms of intellectual property, both in the United States and abroad, including matters relating to combating infringement, and thereby support efforts to reinvigorate the Nation's global competitiveness, accelerate export growth, promote job creation, and reduce threats posed to national security and to public health and safety, it is hereby ordered as follows:
     Section 1.  Senior Intellectual Property Enforcement Advisory Committee.
     (a)  Establishment of Committee.  There is established an interagency Senior Intellectual Property Enforcement Advisory Committee (Senior Advisory Committee), which shall be chaired by the Intellectual Property Enforcement Coordinator (Coordinator), Executive Office of the President.
     (b)  Membership.  The Senior Advisory Committee shall be composed of the Coordinator, who shall chair it, and the heads of, or the deputies to the heads of:
(i)     the Department of State;
(ii)     the Department of the Treasury;
(iii)     the Department of Justice;
(iv)     the Department of Agriculture;
(v)     the Department of Commerce;
(vi)     the Department of Health and Human Services;
(vii)     the Department of Homeland Security;
(viii)     the Office of Management and Budget; and
(ix)     the Office of the United States Trade Representative.

A member of the Senior Advisory Committee may, in consultation with the Coordinator, designate a senior-level official from the member's department or agency who holds a position for which Senate confirmation is required to perform the Senior Advisory Committee functions of the member.
     (c)  Mission and Functions.  Consistent with the authorities assigned to the Coordinator, and other applicable law, the Senior Advisory Committee shall advise the Coordinator and facilitate the formation and implementation of each Joint Strategic Plan required every 3 years under title III of the PRO IP Act (15 U.S.C. 8113), consistent with this order.
     (d)  Administration.  The Coordinator shall coordinate and support the work of the Senior Advisory Committee in fulfilling its functions under this order.  The Coordinator shall convene the first meeting of the Senior Advisory Committee within 90 days of the date of this order and shall thereafter convene such meetings as appropriate.
     Sec2.  Intellectual Property Enforcement Advisory Committee.
     (a)  Establishment of Committee.  There is established an interagency Intellectual Property Enforcement Advisory Committee (Enforcement Advisory Committee), which shall be chaired by the Coordinator.  The Enforcement Advisory Committee shall serve as the committee established by section 301(b)(3) of the PRO IP Act (15 U.S.C. 8111(b)(3)).
     (b)  Membership.  The Enforcement Advisory Committee shall be composed of the Coordinator, who shall chair it, and representatives from the following departments and agencies, or units of departments and agencies, who hold a position for which Senate confirmation is required, who are involved in intellectual property enforcement, and who are, or are designated by, the respective heads of those departments and agencies:
(i)     the Office of Management and Budget;
(ii)     relevant units within the Department of Justice, including the Criminal Division, the Civil Division, and the Federal Bureau of Investigation;
(iii)     the United States Patent and Trademark Office, the International Trade Administration, and other relevant units of the Department of Commerce;
(iv)     the Office of the United States Trade Representative;
(v)     the Department of State, the Bureau of Economic, Energy, and Business Affairs, the United States Agency for International Development and the Bureau of International Narcotics and Law Enforcement Affairs;
(vi)     the Department of Homeland Security, United States Customs and Border Protection, and United States Immigration and Customs Enforcement;
(vii)     the Food and Drug Administration of the Department of Health and Human Services;
(viii)     the Department of Agriculture;
(ix)     the Department of the Treasury; and
(x)     such other executive branch departments, agencies, or offices as the President determines to be substantially involved in the efforts of the Federal Government to combat counterfeiting and infringement.
Pursuant to the PRO IP Act (15 U.S.C. 8111), the Coordinator shall also invite the Register of Copyrights, or a senior representative of the United States Copyright Office designated by the Register of Copyrights, to serve as a member of the Enforcement Advisory Committee.
     (c)  Mission and Functions.
(i)     Consistent with the authorities assigned to the Coordinator and the Enforcement Advisory Committee, and other applicable law, the Enforcement Advisory Committee shall develop each Joint Strategic Plan as provided for in title III of the PRO IP Act.  In the development and implementation of the Joint Strategic Plan, the heads of the departments and agencies identified in section 2(b) of this order shall share with the Coordinator and the other members of the Enforcement Advisory Committee relevant department or agency information, to the extent permitted by law, including requirements relating to confidentiality and privacy, and to the extent that such sharing of information is consistent with law enforcement protocols for handling such information.  Such information shall include:
(A)  plans for addressing the Joint Strategic Plan;
(B)  statistical information on the enforcement activities taken by that department or agency against counterfeiting or infringement; and
(C)  recommendations to enhance cooperation among Federal, State, and local authorities responsible for intellectual property enforcement.
(ii)     The Coordinator may establish subgroups, consisting exclusively of Enforcement Advisory Committee members or their designees, who must be officials from the designating member's department or agency, to support the functions of the Enforcement Advisory Committee.  The subgroups shall be chaired by the Coordinator, or the Coordinator's designee with expertise and experience in intellectual property enforcement matters, and may include:
(A)  an Enforcement Subcommittee; and
(B)  other subcommittees as the Coordinator deems appropriate, including subcommittees addressing particular enforcement issues, efforts, training, and information sharing among departments and agencies.
     (d)  Administration.  The Coordinator shall coordinate and support the work of the Enforcement Advisory Committee in fulfilling its functions under this order and under section 301(b)(3)(B) of the PRO IP Act (15 U.S.C. 8111(b)(3)(B)).  The Coordinator shall convene meetings of the Enforcement Advisory Committee as appropriate.
     Sec3.  General Provisions.
     (a)  Nothing in this order shall be construed to impair or otherwise affect the:
(i)     authority granted by law to an executive department, agency, or the head thereof, or the status of that department or agency within the Federal Government; or
(ii)     functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.
         (b)  This order shall be implemented consistent with applicable law and subject to the availability of appropriations.  Consistent with section 301(b)(2) of the PRO IP Act (15 U.S.C. 8111(b)(2)), the Coordinator may not control or direct any Federal law enforcement agency in the exercise of its investigative or prosecutorial authority.
         (c)  This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

Dennys Funny Quotes: Funny Mardi Gras Quotes, Who Dat Rocking Saints Songs - Congrats go to the Packers who won this year's Super Bowl! Let the partying begin!

Here is last year's winner, the New Orleans Saints. What a huge surprise it was to win the Super Bowl, the first for this beaten down team. Get a grin at the partying in the French Quarter and the different rock songs for the team.

The Packers have their Cheesehead song and the Saints have their Who Dat?! song. For my second language friends: Who Dat = Who is that?

Right after Hurricane Katrina, all in a half a million strong flurry, half of New Orleans moved to my town of Baton Rouge, the state's capital, overwhelming us and our resources. We soon adjusted after a few months and assimilated everyone. They still can't drive. :)

All we heard in the grocery stores and the shopping malls was the "Who dat?" phrase. We soon started calling New Orleans people The Who Dats and the name stuck with New Orleans wearing it like a badge of pride. :) Winning the Super Bowl was just what New Orleans needed to make them feel really good. There is still a lot of celebrating going on - but then that's the New Orleans Who Dat Nation!

From Denny: There is a lot going on all around planet Earth when it comes to a restlessness of the people with their governments. It isn't just about Tunisia and Egypt. The people in Haiti are still unsettled after billions of dollars in world aid yet to be spread out among the people to help them rebuild. Iran continues with a harsh regime, executing helpless innocent women right along with the innocent men too. What a dark time it is in the Islamic world as women - and the educated, along with the peaceful people - all struggle for a better life and more responsive government. My prayers are with them.

Egypt Revolution Cartoons

Check out the latest political opinions from American cartoonists about the revolution in Egypt. Adding new cartoons as they become available so check back often.




From Denny: For the past week Egypt has been on a dizzying and fast-paced course to change their history. Hopefully, this will be mostly a peaceful transition to a new democracy.

There is a lot at stake as easily one million protesters have taken to the streets. The people have organized themselves into protection groups to guard their neighborhoods and their priceless museums.

What is at stake for the rest of the world is whether the new government will be friendly toward the Western nations who need trade and oil to continue. As it stands, the Suez Canal must remain open or the price of oil will sky rocket for the world.  No one can pay those prices in this down economy.  Or will the world end up with yet another anti-social backward leaning religious autocracy like we could expect from the Muslim Brotherhood?

Fortunately, President Obama has decided to finally pressure Mubarek to resign or at least leave once there are elections in September. Frankly, I doubt Mubarek can hold on that long. The smart thing to do is for Egyptians to create a temporary government with the opposition leader of their choice until free and fair elections can be held. Mubarek is so odious to the rank and file Egyptian there is just no way he can remain.  If Obama wants to help stabilize the world economy he had better get a move on and give Mubarek "the bum's rush" before there is yet another assassination.  Convince this guy to leave now in an orderly fashion.
